Part B - General Terms and Conditions

1. Definitions and interpretation

“Promoter” means Camera Champ, ABN 69 133 919 152. “Giveaway” means the promotion identified under “Promotion name” in Part A, a separate game-of-chance trade promotion associated with the photo contest identified in Part A. “Contest” means the separately judged, paid-entry photo contest identified under “Associated photo contest” in Part A. “Entrant” means one eligible natural person, irrespective of the number of transactions, emails or accounts they use. “Giveaway Entry” means one valid electronic chance in the Giveaway draw. “Qualifying Purchase” means an eligible, fully paid entry option for the Contest purchased during the promotional period. “Terms” means Part A and Part B of this document.

The paid-entrant limit specified in Part A applies only to unique individuals who make Qualifying Purchases. A person making multiple qualifying purchases counts once towards that paid-entrant limit. Individuals using the free mail-in route do not count towards that limit. Giveaway Entries and entrants are different measures. Part A prevails over Part B to the extent of an inconsistency.

2. Acceptance and separate promotions

The Giveaway is a game of chance. Giveaway winners are determined by a random draw and not by photographic skill. The Contest is a separate game of skill, with its own entry, judging, prize and submission conditions.

Giveaway entries accompanying a Qualifying Purchase are issued automatically when the paid order is confirmed and are not separately sold. Uploading photographs, completing a photographic submission, or winning or being judged in the Contest is not a condition of retaining valid Giveaway Entries. The number of photos submitted, or their quality, does not affect the Giveaway draw.

The Giveaway Terms apply to the free entries issued with a qualifying Contest purchase and entries accepted through the no-purchase mail-in route. The Contest’s own terms govern the purchased photographic service. Participation in the Giveaway constitutes acceptance of these Terms.

3. Eligibility

Open to individuals aged at least 18 years (and the higher age of majority where required by local law) who legally reside in Australia excluding the Australian Capital Territory, South Australia and Northern Territory; New Zealand; the United Kingdom; or the 50 United States and District of Columbia, where participation and prize award are lawful. Void where prohibited.

Employees of Camera Champ, its prize retailers, suppliers, associated companies and promotion agencies, and their immediate families, are ineligible. The Promoter may verify identity, age and residence. Entries from excluded locations are not valid and must not be issued or entered into the draw.

4. Promotional period

The Giveaway starts and closes on the opening and closing dates and times specified in Part A. All times will be AEST (UTC+10) when announced. This Giveaway is one promotional period and one prize draw, not an ongoing membership or a recurring series of automatic draws.

The Giveaway may close to new qualifying purchasers when the paid-entrant limit is reached, in accordance with clause 5. The no-purchase mail-in route remains available to eligible individuals until the stated promotional closing time, regardless of whether the paid-entrant cap has been reached. The dates and other outstanding particulars in Part A must be completed and published before the promotion opens.

5. Entry limit

The intended limit on unique paid entrants, together with the permitted processing allowance and absolute maximum, is specified under “Entry limit” in Part A. The allowance accommodates payment-processing delays, automatic entry issuance, software delays and manual monitoring.

For this cap, a paid entrant means one eligible natural person who makes at least one Qualifying Purchase. The same person counts only once regardless of the number of purchases, email addresses or accounts used, or the number of complimentary Giveaway Entries issued. Multiple purchases by one person do not increase the paid-entrant headcount.

The number of unique paid entrants may exceed the intended limit only up to the absolute maximum stated in Part A. Camera Champ may stop accepting new qualifying purchasers or stop offering giveaway entries to new purchasers once the limit is reached. Further valid qualifying purchases by already-admitted paid entrants may generate additional complimentary entries while the promotion and eligible purchase offers remain open, subject to the published terms.

Free mail-in entrants are excluded from the paid-entrant cap. Valid no-purchase mail-in entries may continue to be accepted until the published promotional closing time even after the paid-entrant cap has been reached. Mail-in entries remain subject to all other eligibility and entry requirements. The total number of participants and Giveaway Entries in the draw may therefore exceed the maximum paid-entrant figure stated in Part A. This cap is aligned with the separate Contest unique paid-entrant limit; it is not a limit on the total number of free entrants or drawing chances.

6. Automatic complimentary entries with photo contest purchases

An eligible customer who completes a Qualifying Purchase during the Giveaway period is automatically allocated the corresponding complimentary Giveaway Entries. There is no separate fee for Giveaway Entries, and the purchased product is entry into the genuine judged Contest.

The applicable entry options and numbers of complimentary Giveaway Entries are listed under “Complimentary entry allocation” in Part A.

One Contest entry option may be purchased per order. An eligible person may purchase additional options in separate orders while entry sales are open and receive the additional complimentary entries shown for each paid qualifying order. These additional entries do not increase the unique-entrant headcount.

The relevant paid Contest entry option includes the complimentary publications-library and photography-tools access described in the Contest terms. No continuing subscription or recurring payment is created by those inclusions.

Giveaway entries are issued when the qualifying paid order is confirmed and are independent of whether the customer later uploads any photographs. The customer may choose not to submit photographs in the Contest, without forfeiting otherwise valid automatically issued Giveaway Entries.

An unpaid, unauthorised, fraudulent, cancelled or fully reversed purchase does not qualify. Any cancellation or invalidation of related Giveaway Entries after a refund or chargeback must comply with applicable law and must not override rights afforded by consumer law. Mere failure to submit photographs is not a reason to cancel giveaway entries.

7. No-purchase mail-in entry method

No purchase or payment to Camera Champ is required. An eligible individual may request ten (10) free Giveaway Entries for each compliant entry form, mailed to: Camera Champ, PO Box 5274, Q Supercentre QLD 4218, Australia. The printable entry form is available at the mail-in entry page. The entry must arrive no later than one (1) calendar day before the published promotional draw date.

Account and email subscription requirement: Before mailing the free entry form, the entrant must create a Camera Champ customer account at www.camerachamp.com. The mail-in request form must contain the same email address and the same physical address as that registered to the Camera Champ account. On receipt, Camera Champ must be able to match the request to an existing account. A request that cannot be matched may be rejected following reasonable verification. No purchase is required to create the account or submit a mail-in entry.

Each separate entry form must contain its mailing date, full first and last name, residential street address, city, state or region, postcode or ZIP code, country, date of birth (dd/mm/yyyy), registered Camera Champ account email address, and telephone number including country code. No First Prize selection is required or accepted at the time of entry. Only one request may be enclosed per mailing item. Bulk shipments, photocopies, printed or mechanically reproduced entries and illegible or incomplete requests are not accepted.

Postage: Each letter must be sent with a physical adhesive postage stamp affixed to the outside of the mailed item, of sufficient value for delivery to the Australian address. Prepaid envelopes, postage-paid envelopes, digitally printed or ink-printed postage indicia, printed stamps, meter impressions, and franked or metered mail are not accepted. An entry form mailed without an envelope or a qualifying physically affixed postage stamp is invalid.

Mail-in entries do not count towards the paid-entrant limit specified in Part A, and the paid-entrant cap does not bring the mail-in method to an early close. Each otherwise valid mail-in request received by the published closing time may qualify for one entry. Proof of postage is not proof of receipt; Camera Champ is not responsible for mail lost or delayed beyond its reasonable control.

All accepted mail-in entries are pooled in the same random draw as complimentary entries issued with qualifying Photo Contest purchases. Every valid Giveaway Entry has an equal chance of selection. The account conditions described above apply to the mail-in route; Camera Champ will handle personal information in accordance with its privacy policy and applicable law.

8. Entry recording, prize selection and verification

Each valid Giveaway Entry must be recorded against its eligible Entrant. Entrants do not select or nominate a prize option when obtaining Giveaway Entries; the verified winner selects their First Prize option after the draw. Giveaway Entries are not transferable to another person. The Promoter may request evidence to confirm a purchase, mail-in request, identity, eligibility, and entry record.

Entrants must use accurate information. Automated entries, fraudulent identities and attempts to bypass the paid-entrant cap or falsely claim a matching customer account are prohibited. The Promoter may disqualify invalid entries, subject to applicable law and fair administration.

9. Prize draw and winner selection

All valid Giveaway Entries from the purchase-linked and no-purchase entry routes are pooled into one random prize draw. Each Giveaway Entry has an equal chance of being drawn; a person holding more valid entries has proportionately more chances. No photograph is judged for the Giveaway.

One First Prize winner will be randomly drawn. Following identity and eligibility verification, the winner may choose any one (1) of the four First Prize options listed in Part A. No option is associated with a Giveaway Entry before the draw. Only the winner's selected option is awarded. The number and type of prizes are as specified in Part A.

The draw date, time, location and operator are specified under the corresponding items in Part A.

If entry for new qualifying paid purchasers closes early at the paid-entrant cap, the mail-in route stays open until the published closing time and the draw will occur at the published draw time unless a lawful, publicly notified amendment is made.

10. Prizes and value

The First Prize is one (1) of the four options specified in Part A. The verified winner chooses the preferred option after the draw and during the prize-claim process. Only that one selected prize option is awarded, not all four. The prize choice must be communicated to Camera Champ in writing and is final once the prize order has been placed or the cash transfer has been initiated, except as otherwise required by law.

The maximum advertised prize value and First Prize options are specified in Part A. The three camera gear options must be fully specified and disclosed before the Giveaway opens. The cash option is a separate, expressly offered prize choice and is not a right to exchange a camera gear option for its retail value. The winning entrant cannot demand the cash equivalent of a camera gear prize or any difference in value between the advertised alternatives. Prize entitlements cannot be transferred to another person unless required by law.

“Valued At” amounts are estimates derived from manufacturers’ or distributors’ recommended retail prices and/or standard retailer prices, not guaranteed resale values. The actual retailer price may differ. If a prize is genuinely unavailable, substitution of an equal or greater value is subject to applicable regulatory requirements and any required approvals.

Winners are responsible for confirming prize compatibility and suitability. Prize items are sourced through suppliers or retailers. Manufacturer and retailer warranties and all non-excludable statutory consumer rights continue to apply.

11. Cash prize payment through Wise

If the verified First Prize winner chooses the cash option identified in Part A, Camera Champ will pay the Australian-dollar amount stated there by electronic bank transfer arranged through Wise, subject to the availability of Wise's payment services and any applicable legal or regulatory checks. The winner does not need a Wise account but must nominate an eligible bank account held in their own legal name and capable of receiving the payment.

Currency conversion: The cash prize is denominated in Australian dollars (AUD), not a fixed foreign-currency amount. A winner whose eligible receiving bank account is in Australia will be paid in AUD. For a winner in the United States, New Zealand or United Kingdom, Camera Champ will arrange conversion into USD, NZD or GBP respectively at the applicable Wise exchange rate when the transfer is actually executed. Exchange rates change over time; no foreign-currency amount or earlier quoted rate is guaranteed. Any estimate supplied before execution is indicative only. The recipient amount will be based on the advertised AUD prize, converted at the applicable rate, with Camera Champ paying the transfer and conversion fees described below.

Transfer fees: Camera Champ will bear Wise's sending fee, currency-conversion fee and any ordinary transfer or intermediary fees necessary to deliver the stated prize through the chosen payment route, without deducting those fees from the advertised AUD prize amount before conversion. Camera Champ will take reasonable steps to ensure the winner receives the full converted proceeds of the prize. Charges associated with the winner's own bank account or personal banking arrangements that are unrelated to making the prize transfer, including account-maintenance charges, overdraft charges or later withdrawal fees, are the winner's responsibility. If an unexpected receiving or intermediary bank deduction affects the prize transfer, the winner should notify Camera Champ promptly so it can investigate and reasonably arrange correction or reimbursement where the deduction is a fee of sending or receiving that prize transfer. Nothing requires Camera Champ to reimburse a winner's independent taxes or unrelated banking charges.

Bank information and verification: To receive the cash prize, the winner must provide accurate bank account holder name, bank name and country, account number and applicable identifiers such as BSB, sort code, routing number, IBAN or SWIFT/BIC, together with any information reasonably needed by Camera Champ, Wise or the recipient bank for lawful identity, anti-fraud, sanctions, anti-money-laundering and payment verification. Details must be provided through a secure method requested by Camera Champ and must not be published in comments or on social media. Camera Champ may request reasonable evidence that the nominated bank account belongs to the winner.

Timing, rejected payments and alternatives: After the winner has accepted the cash option, established eligibility and supplied complete verified bank details, Camera Champ will initiate payment within a reasonable time, ordinarily within seven (7) business days, subject to compliance reviews and the processing time of Wise and the receiving bank. Incorrect information, banking restrictions, intermediary checks and events beyond Camera Champ's reasonable control may delay a transfer. Camera Champ will make reasonable efforts to trace, correct or resend a failed or returned payment. If Wise cannot lawfully or practically complete the transfer, Camera Champ and the winner will seek a reasonable lawful alternative bank-transfer arrangement without automatically forfeiting an otherwise valid cash prize, subject to any required regulatory approval. Camera Champ will not charge the winner a prize-claim or release fee.

Taxes and external obligations: The winner is responsible for determining, declaring and paying any personal income tax or other tax legally imposed on them as a result of receiving the prize, including any tax obligations in their country of residence. Camera Champ does not provide tax advice and is not responsible for the winner's personal tax liabilities or penalties resulting from the winner's failure to comply with their legal obligations. Camera Champ may make deductions or provide tax reporting only where required by applicable law and will disclose any legally required withholding to the winner. The winner should seek independent tax advice as appropriate.

Camera Champ is not responsible for delays or losses resulting solely from materially incorrect information supplied by the winner or circumstances outside its reasonable control, but will take reasonable steps to assist in resolving payment issues. Nothing in this clause excludes or restricts liability, consumer rights or prize-payment obligations that cannot lawfully be excluded.

12. Winner notification, claim and redraw

Winners will be notified by email and/or telephone within seven days after the draw. The winner’s name, state or region and country may be published on the Camera Champ website within fourteen days after the draw, subject to applicable legal requirements and privacy law.

The winner must respond, verify eligibility, choose one of the four First Prize options and claim the prize by the prize redemption deadline specified in Part A. The choice is made after the draw, never when entering. Backup winners may be drawn at the original draw and called upon in order if a winner is invalid or cannot claim. If required, an unclaimed-prize redraw will take place on the date stated in Part A, with any necessary regulatory approval. Winners of an unclaimed prize will be notified within seven days.

Camera Champ may request reasonable proof of identity, age, residency and any relevant transaction or mail-in record. The claim period cannot override mandatory statutory requirements.

13. Prize fulfilment and delivery

If the winner chooses a camera gear option, Camera Champ will arrange fulfilment through its nominated authorised supplier or retailer, ordinarily initiating the order within seven days after successful prize redemption, subject to stock and logistical considerations. If the winner chooses the cash option, fulfilment is governed by clause 11.

A winner choosing camera gear must provide a correct and complete delivery address. Delivery, shipping insurance, damage, missing parcels, replacement and statutory remedies are governed by applicable consumer law and the relevant supplier or carrier terms; no clause excludes liability that cannot legally be excluded.

Winners are responsible for any personal tax obligations associated with prizes, to the extent required by law.

14. Privacy, publicity and communications

Camera Champ collects entrant details to administer the Giveaway, verify eligibility, conduct draws, contact winners, deliver prizes and meet legal obligations. Information may be shared with administrators, draw operators, delivery providers and authorities where reasonably necessary. See Camera Champ’s published privacy and website terms.

Winners may be requested to participate in reasonable promotional publicity, subject to privacy, publicity and consumer law. The Promoter may identify winners as required by law. Separate optional marketing subscriptions must not be a condition of the free entry route.

15. Optional winner photograph and website publicity

The verified First Prize winner is encouraged, but is not required, to email Camera Champ a clear photograph of themselves for winner publicity on the Camera Champ website. A portrait showing the winner from the waist to the head or from the chest to the head is preferred.

By voluntarily providing the photograph for this purpose, the winner authorises Camera Champ to display that photograph on the Camera Champ website solely in connection with announcing or publicising the winner of the Giveaway. The photograph will not be used on social media, in paid advertising, in printed publications or for any other purpose without the winner's separate permission.

If Camera Champ receives a suitable photograph, it will begin organising the winner's selected prize following the applicable eligibility, prize-choice and claim verification requirements.

If the winner chooses not to provide a photograph, Camera Champ may need additional reasonable time to reconfigure the winner-publicity page and related website sections to present the announcement without the photograph. Camera Champ will nevertheless proceed with prize fulfilment within the applicable lawful timeframe and will not withhold, cancel or forfeit the prize solely because a photograph was not provided. The winner may inform Camera Champ by email that they do not wish to supply a photograph.

16. Technical issues and prohibited conduct

Camera Champ may investigate and remedy delayed, missing or duplicate automatic entry issuance and mail-in recording errors. A successful qualifying payment should not be denied its promised complimentary entries because of a processing delay, subject to the entrant cap and eligibility rules.

Bots, unauthorised access, deliberate manipulation, identity evasion and fraudulent charges are prohibited. Camera Champ may verify records and disqualify affected invalid entries after reasonable review.

17. Changes, suspension and cancellation

Where the Giveaway cannot lawfully or fairly operate because of fraud, technical failure, supply disruption, force majeure or a regulatory requirement, Camera Champ may suspend, amend or cancel it only as permitted by applicable law and subject to necessary regulator approval. Existing valid entries must be treated fairly.

Any material change affecting eligibility, prize descriptions, the maximum entrant count, closing date or draw details will be published on Camera Champ’s website and notified as legally required. The Giveaway is not an automatically recurring or ongoing promotion.

18. Liability and non-excludable rights

Nothing in these Terms excludes or limits any statutory guarantee, remedy or liability that cannot lawfully be excluded, including under the Australian Consumer Law or applicable overseas consumer protection law.

To the maximum extent permitted by law, the Promoter is not responsible for losses or delays caused by circumstances beyond its reasonable control. The Promoter remains responsible where liability cannot be excluded by law.

19. Complaints, governing law and general provisions

Complaints should be submitted through the Camera Champ contact page. The parties will attempt in good faith to resolve any dispute. Queensland, Australia law governs the Giveaway, subject to mandatory consumer and promotion laws applying in each eligible jurisdiction.

An invalid provision is severed without affecting the remainder where lawful. Failure to enforce a right is not a waiver. Headings are for convenience. All dollar amounts are Australian dollars unless otherwise stated.

20. Social media and manufacturer disclaimer

This Giveaway is not sponsored, endorsed or administered by, or associated with, Meta, Facebook, Instagram, YouTube or any camera or lens manufacturer. Any product brand names identify the advertised prize options only. Questions and claims must be directed to Camera Champ.
